Rules and Procedures of the Competition (“The Rules”)

PART A: HOW TO ENTER AND PARTICIPATE IN THE COMPETITION


Definitions: “The Company”:- Celador Productions Limited, the organiser of the Competition. “The Contestant”:- Any person who enters the Competition in accordance with the Rules. “The Studio Part of the Competition”:- That part of the Competition which takes place in the Studio whether or not recorded for transmission. “The Programme”:- The recordings of the Studio Part of the Competition (including any Seasonal Special recording). “The Show”:- Any one of the episodes of the Programme (including any Seasonal Special episode). “The Seasonal Special”:- Any episode of the Show specially recorded to celebrate a specific time of year. “The Show Date”:- The date of recording of the Show in question. “The Studio”:- Elstree Film Studios, Shenley Road, Borehamwood, Hertfordshire, WD6 1JG or such other studio as the Company may nominate. “The Lifelines”:- The three methods of assisting the Contestants during the Show namely the “50/50" Option; the “Phone a Friend” Option and the “Ask the Audience” Option, the precise detail of which and method of use will be explained in detail during each Show.



1. Entry Procedures to the Competition:

(a) It is a condition of each entry to the Competition via the Premium Rate Telephone Number 09068 44 44 44 that contestants follow the simple procedures given on the telephone. Contestants will be asked if they wish to enter the Competition by agreeing to press/dial the star button twice and then digit 5 on their telephone and thereafter (save in respect of any Seasonal Special) by the selection of which of the Shows in which they would ideally like to participate by pressing/dialling the digits instructed. If a Contestant decides he/she does not wish to enter or wishes to withdraw, the receiver may be replaced at any point. In the case of those who are deaf or hard-of-hearing with the Typetalk facility entries are via 0800 959598 and Contestants must follow the procedures given.

(b) Contestants may enter the Competition as many times as is desired but subject always to Part B Clauses 1 and 12.


2. Call Costs and Helpline:

(a) The call cost is 60 pence per minute (on a per second basis with a minimum charge of 5 pence) lasting no more than 2 minutes (save for in the case of those who are deaf or hard-of-hearing for whom separate conditions apply and Contestants should apply to Typetalk for details).

(b) It is possible that the telephones utilised by Contestants may be incompatible with the telephone system in operation. In such eventuality the Company will endeavour to so advise, provide an alternative telephone number or advise that entry should be made utilising alternative telephone apparatus should Contestants still wish to enter the Competition.

(c) If Contestants are unclear as to the Rules or any element of the Competition or experience difficulties with the telephone system they should call the helpline number on 0870 904 5000 at standard national call rates.


3. Upon entry to the Competition:

(a) Contestants will be asked a general knowledge multiple choice question. If the correct answer is given Contestants will be so advised and be asked to leave their name and telephone number including area code. If an incorrect answer is given Contestants will be so advised and they will then be instructed to replace the receiver thereby terminating their participation in the Competition.

(b) If Contestants answer the question correctly their name will be entered into the Company’s random selection process for possible participation in the Studio Part of the Competition of the Seasonal Special or the Show of their choice as the case may be. This process should be completed in respect of each Show shortly following the closure of the lines for that Show. If the Show in question is not a Seasonal Special and a Contestant failed to choose a Show or the same was incorrectly recorded upon entry to the Competition for whatever reason such Contestant will be allocated to any Show (other than the Seasonal Special) provided that all other relevant details have been correctly given and accurately recorded.

(c) In the event that a Contestant’s name is selected such Contestants will be telephoned on the telephone number provided at a reasonable time on any day until 5pm on the day prior to Recording of the Show in question. If successful contact is made the telephone conversation will be recorded and Contestants will:

(i) be asked to confirm first that they will comply with the Rules (and be advised of where to obtain copies if required) and second their ideal Show Date (and that they agree to participate in the following Show if required in accordance with 4(e) below) or their availability for the Seasonal Special as the case may be. In the event that for whatever reason their ideal Show Date was not correctly recorded upon entry to the Competition and accordingly the Show for which such Contestant has now been selected does not accord with such Contestant’s original choice and/or that Contestant cannot attend on his/her original choice of Show Date or the following Show in accordance with 4(e) below the Company will regretfully be unable to offer an alternative Show Date.

(ii) if the Show Date is agreed (“the Agreed Show Date”) be asked one or more further general knowledge questions which may or may not have multiple choice answers. Subject to the fulfilment of the conditions of the Rules those ten Contestants in respect of each Show who have given the correct or the closest correct answer(s) will be asked to participate in the Studio Part of the Competition on the Agreed Show Date.

(iii) be told the date and approximate time when Contestants will be telephoned again in the event of their successfully answering the further general knowledge question(s) so as to arrange for their attendance at the Studio on the Agreed Show Date.

(d) Upon successful contact and agreement with Contestants as to the arrangements for such Contestants’ attendance at the Studio:

(i) Contestants must attend the Studio by 2pm on the Agreed Show Date.

(ii) Contestants may bring one relative or friend who will join the Studio Audience of the Show.

(iii) The reasonable travelling and any other agreed necessary expenses of both the Contestant and his/her friend will be reimbursed. No fee will be paid for any attendance at the Studio or in respect of any loss of earnings thereby incurred.

(e) In the event of the failure of any Contestant to attend the Studio by the aforesaid time for any reason whatsoever the Company shall be entitled to exclude such Contestant(s) from the Show and the Studio Part of the Competition.

(f) There will be two reserve Contestants for each Show and these will be selected, contacted and arrangements made for their attendance on the Agreed Show Date in accordance with the procedures outlined above and who shall be entitled to take the place of Contestants in the event that the Show Dates for Contestants cannot be agreed or Contestants fail to attend on the Agreed Show Date at the time specified or at all or Contestants are ineligible under the Rules or Contestants are excluded from the Studio Part of the Competition in accordance with Part B, 3. below.



4. The Studio Part of the Competition:

(a) Each Show Player selected in accordance with the procedures specified below shall be entitled to answer up to fifteen general knowledge questions with multiple choice answers so as to afford him/her the opportunity of competing for the sum of £1 million. The questions will be divided into three different categories with the third category being the most difficult and the first the least difficult.

(b) On the Agreed Show Date Contestants will be met at the Studio by a representative of the Company. Contestants will be required to sign an agreement in standard form for contributors to television programmes and shall include (i) their confirmation that they have understood and agree to the Rules and (ii) their consent to the recording of their contribution to the Show in question, and thereafter to the broadcast and all other exploitation of this and to the publication of his/her name and photograph in all media.

(c) Upon commencement of each Show (or if a Show Player (as defined below) is in the middle of play from the preceding Show following the end of play by such Show Player) the ten Contestants for the Show in question will be asked to compete with one another by answering a further general knowledge question which may or may not have multiple choice answers. The Contestant answering correctly in the fastest time will go forward to answer up to a further fifteen general knowledge questions (“The Show Player”) in return for cash prizes.

(d)

(i) The Show Player will be shown each question together with the four multiple choice answers in advance of deciding whether he/she wishes to continue play. Prior to answering any question a Show Player may withdraw from the Competition and retain all cash so far won notwithstanding the use of one or more of the Lifelines (provided for the avoidance of doubt the question has not been answered).

(ii) If a question is incorrectly answered the Show Player will lose all winnings in the category in which he/she is currently playing but will retain the winnings arising out of his/her success in the preceding category and will thereafter be disqualified from this entry to the Competition.

(iii) The Show Player will be entitled to use each of the three Lifelines on one occasion only which may be used either individually in respect of any question or in respect of the same question in any one of the three categories. For the avoidance of doubt in the event that the “Phone a Friend” Lifeline is used such friend shall have no claim upon the Company of whatsoever nature.

(e) In the event that a Show Player withdraws or answers a question incorrectly the Contestants for the Show in question may be invited by the Company (in its sole discretion) to participate in the same procedure set out in (c) above for that Show only and the successful Contestant will become the Show Player. In the event that any Show Player has not yet completed his/her opportunity to answer up to fifteen questions and the Company determines (in its sole discretion) that sufficient material for the Show in question has been recorded such Show will come to an end and the Show Player must appear in the following Show.

(f) The Company shall have no responsibility by reason of any variation in the length of the Studio Part of the Competition.

(g) Payment to Show Players will be sent by cheque within seven days of broadcast of the relevant Show.


PART B: GENERAL RULES

1. Any person who has appeared as a Show Player; employees of the Company, ITV, any sponsor, all sub-contractors and agents rendering services in respect of the Competition and members of their immediate family including any live-in partner; persons under 16 years of age or with criminal convictions which have not been spent in accordance with the Rehabilitation of Offenders Act 1974 (other than driving offences which have not resulted in a ban or more serious sentence) are ineligible to enter the Competition. Persons may not participate from outside the United Kingdom. Failure to provide proof of eligibility within a reasonable time upon request by the Company may result in disqualification and/or the withholding or withdrawal of a prize.

2. Persons must not confer with others when answering questions and must enter the competition on their own behalf and entries by proxy will not be accepted. A Show Player must not leave the set unless told by the Company to do so.

3. The Company may in its sole discretion exclude Contestants from participation in the Studio Part of the Competition which may include without limitation (i) circumstances in which in the Company’s reasonable view render Contestants unfit to participate therein; (ii) inability to produce documentation specified by the Company proving the identity of the Contestant.

4. The Company may refuse to pay winnings or reclaim all sums paid to Show Players in the event of his/her fraud, dishonesty or non-entitlement to participate in the Competition under the Rules.

5. In the event of any fault, misunderstanding or dispute concerning the operation of any part of the Competition, and/or the operation of the telephone system, or the validity of any answer the decision of the Company shall be final.

6. To the fullest extent permitted by law the Company reserves the right to amend the Rules or terminate the Competition at any time which amendment/termination will be published and shall be applicable as from the date of such publication (without Contestants having any claim on the Company).

7. All Contestants agree to abide by the Rules including these General Rules.

8. If the operation of the Competition (including without limitation the operation of the telephone system); the recording; broadcast of any/all of the Shows is affected by circumstances beyond the reasonable control of the Company or is prevented by reason of any actual, anticipated or alleged breach of any law or applicable regulations the Company may cancel all or any part of the Competition and Contestants shall have no claim upon the Company.

9. Whilst the Company shall make all reasonable endeavours to (i) enable Contestants to proceed with their ideal Show (ii) to contact all Contestants at each relevant juncture of the Competition the Company can make no guarantee therefore and the Company shall in its sole discretion be entitled to proceed with the next entitled Contestant under these Rules.

10. Notwithstanding a Contestant’s participation in the Competition there is no obligation on the part of the Company or ITV to broadcast any Show in which he/she has taken part, or any or all of his contribution as recorded by the Company.

11. Copies of the agreement referred to in Part A clause 4(b) can be obtained from the Company by sending a self addressed envelope to WWTBAM at PO BOX 4444 London WC2E 9TA.

12. Subject always to Part B Clause 1 Contestants may make multiple entries to the Competition and multiple applications in respect of the same show. In the event that any such Contestant(s) is selected more than once for the same show under the random selection process specified in clause 3(b) above such Contestant will be entitled to answer the further general knowledge question(s) once only.

13. All funds accrued via the premium rate telephone lines will be available as prize money after costs specifically related to the publicity and contestant selection.

14. The Company has endeavoured to make reasonably practicable arrangements to minimise telephone system difficulties but can make no guarantee therefore.

15. A competition bearing the same title as this Competition may be promoted by a third party. The Company bears no responsibility for any such competition and accordingly it should not be confused with this Competition.
